In a case that may well shock many, a Florida mother was taken into police custody on Dec. 4 for allegedly attempting to sell one of her children: an 8-month-old baby boy. She was charged with illegal adoption and was taken to jail in lieu of $25,000 bond. In a further twist to the story, two men are now fighting for child custody over the boy.

One of the men is the boy's legal father. He is currently married to the mother, and he is the father of her two other children. However, it appears the two have since separated, as he reportedly lives elsewhere with a girlfriend. The second man claims to be the boy's biological father. Nonetheless, a judge awarded temporary custody to the boy's legal father in a court proceeding on the afternoon of Dec. 6.

In child custody matters, there are many issues that a court takes into consideration. Here, the biological father's claim may contend against the legal father's claim, but he must first prove to the court that he is truly the biological father. To do this, the man plans on taking a paternity test. If that test proves that he is the boy's biological father, then he will fight once more for custody of the 8-month-old boy.

Although this case is certainly unusual, it is not unusual for a Florida family court judge to be confronted with two parties who are battling for child custody. To make a final determination, a judge will typically weigh a number of factors in deciding what is in the best interest of the child.
